Bankruptcy Case

Filing for bankruptcy is a complex and stressful undertaking. To make the process easier it is important that you speak to an experienced bankruptcy attorney and compile your financial and legal data. I have created a list of documents you will need to file for bankruptcy. These documents are not needed for an initial consultation where we will focus on the “big picture.”

Financial Records

These records will help us to determine whether you are a candidate for Chapter 7 or Chapter 13 bankruptcy.

  • Recent bank statements
  • All of the recent bills for each of your creditors
  • Last 6 months of pay stubs
  • Last 2 years of tax returns

Legal Documents

It is important to disclose any past and current litigation against you. This information will also help us to determine which type of bankruptcy you are best suited for.

  • Files from previous litigation, including any judgments that have been entered against you
  • Current litigation documents you have received
  • Any divorce decree or other court order that requires you to pay child support or maintenance

Additional Documents

The following documents will show that you have a set income level. By showing your income you will be able to show that you have a lack of income to repay your debts.

  • Your lease or mortgage
  • Vehicle titles
  • Insurance policies
  • Any promissory notes you have signed
  • Other documents relating to debts you owe other people
  • Any proof that anyone owes you money
  • Any lawsuits with which you have been served
  • Correspondence with or regarding creditors, including threat letters from collection agencies and lawyers
